Minutes of Commission meeting held on March 13, 2007.
~
Present:  Mary vandenBerg, Chairperson, Steven Anderstrom, Patricia Caron, Howard Fife, Rolf Hilbig,   Kathleen McGrory and James Wettlaufer.

7:00 p.m.  Chairperson called the meeting to order.

7:05 p.m.  Minutes of Commission Meeting held on March 6, 2007 were read, accepted and will be distributed.

7:10 p.m.  Joel Jette, Builder was helped in completing the Notice of Intent for Richard Chapin of 28 Hamilton Dr. R-41-B-71.01 to construct a 10’ x 20’ dining room on the existing deck.

7:20 p.m.  James Wettlaufer reported having met with Lee Lyman of Lycott Engineering regarding the management of Aquatic Vegetation of Hamilton Reservoir.  He gave Jim a copy of the Massachusetts regulations 310 CMR Section 10.05 (8) Extensions of Orders of Conditions which indicates that the HCC does not have to submit a new Notice of Intent for the management of the Massachusetts portions of Hamilton Reservoir.  We need only apply for an Extension on Form 7.

7:30 p.m.  The Public Hearing of Robert Terwilliger of 49 /51 Sandy Beach Rd. map R-36-K7-8.  DEP file #184-0213 to construct a SFH, driveway, septic, well and associated grading was presented by Mark Farrell of Greenhill Engineering.  Brad Noble was the only abutter.  The well site is still questionable.  The Public Hearing will be continued on April 10, 2007 at 7:30 p.m.  One of the Order of Conditions will require the well to be dug before any other work is done.

7:45 p.m.  Procedure Sheet #2006-1164 issued to James Hazen of 33 Lakeridge Dr. map R-04-A-13 to install a new septic system.  Plot plan was reviewed, stamped and marked with color where silt fence and hay bales should be placed.  Procedure Sheet was signed by Mary vandenBerg with the above conditions.

8:00 p.m.  The Public Hearing of Mark Gadoury of 46 Stony Hill Rd. map R-35-C-6, DEP File #184-0214 to construct a SFH was presented by Mark Farrell of Greenhill Engineering.  Mark Gadoury and Steve Morris, builder, were present.  No abutters came.   Following discussion, motion was made to accept the project.  All were in favor of closing the hearing at 8:15 p.m.

Mark Farrell gave us a check of $67.50 paying for The Notice of Intent filing fee for Normand Bachand of 3 Vinton Ln.  The project is an addition to a single family house.  The Public Hearing is scheduled for April 3, 2007 at 7:30 p.m.

8:25 p.m.  Procedure Sheet #2006-1165 issued to Northeast Concepts of 00 Mashapaug Rd. map 10-A-06 to demolish existing camp was presented by Michael LaMountain.  He said a dumpster will be on-site to contain all materials.  Motion was made by Howard Fife to not sign the Procedure Sheet since he has an outstanding Enforcement Order from the HCC as he has not been complying with the Wetlands Protection Act.  Motion was seconded by James Wettlaufer.  All were in favor, none were apposed.

James LaMountain came in unannounced, irate, that the Northeast Concepts Procedure Sheet #2006-1165 had not been signed by the HCC.  Mary vandenBerg, Chairperson, asked him to leave, he ignored her, continuing with his argument which quickly deteriorated into a shouting match involving several members of the HCC. Mary vandenBerg, Chairperson, again ordered Mr. LaMountain to leave and he complied.  After the next meeting had started, 2 State Police entered and said they were responding to a call regarding a verbal altercation.  By that time Mr. LaMountain had left the premises.  During the verbal altercation, feeling threatened, Howard Fife had gone across the hall and asked the Recreation Committee to call the police.
8:40 p.m.  Bob Benoit and Elisa Deminico having bought John Bunn’s property at 90 Maybrook Rd. that still has an outstanding Emergency Order came with that concern.  Following discussions, we agreed to postpone repairs until the Pioneer Valley Planning Commission (PVPC) has completed their study.  Their phone number is in the Flood File.

9:05 p.m.  Gary and Louise Violette of Lot 2, Mashapaug Rd. showed us a receipt of their recorded Order of Conditions from the Registry of Deeds.  Mary vandenBerg signed their Procedure Sheet #2007-1161.

        We received from Greenhill Engineering a $200.00 check paying for the Legal Ads of W. Cromack, G. Violette, R. Terwilliger and M. Gadoury.

        We Received from Division of Administrative Law Appeals a copy of a pre-hearing conference to be held May 10, 2007 at 11:00 a.m. regarding the James LaMountain and Northeast Concepts, Inc. matter.  Agent Howard Fife is to investigate.

        We received from Huguenot Farms a booklet entitled Farming in Wetland Resource Areas.

Members signed Vendor Voucher paying the Republican $38.25 for R. Chapin’s Legal Ad.

The site visit to Lot 5, Mashapaug Rd. to determine whether any more trees can be cut down by the water’s edge while it is still frozen was done on March 10, 2007 at 10:00 a.m.  Members of the HCC and Andy Cormier, Jr. of Escape Estates were present.  It was determined that he could cut trees labeled 10-11-12 and 13 that are directly in front of the house along the waters edge.  Also, 1 maple can be cut and branches trimmed where the dock will be placed.

Motion to adjourn was made, seconded and approved by all. Meeting adjourned at 9:10 p.m.
